By accessing or using Postflare ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

Service Description

Postflare is a transactional email sending platform built on Cloudflare infrastructure. The Service provides:

  • A REST API and dashboard for sending transactional emails

Account Registration

Service Tiers and Limits

How Emails Are Counted

Wherever these Terms, the dashboard, or our documentation state a number of emails, one email means one recipient address on one message. A single API request naming multiple recipients in to, cc or bcc counts as one email per address. A request naming 100 addresses therefore consumes 100 emails from your monthly allocation, not one.

Emails you receive through the Service count towards the same monthly allocation as emails you send.

An email counts towards your allocation when we perform the send on your behalf — including when the recipient address is refused because it is on your suppression list, and including when the message is subsequently bounced or reported as spam. An email does not count towards your allocation if you cancel it before it is sent, if it is scheduled and has not yet been sent, or if the Service fails to compose or dispatch it.

Limitation of Liability

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We do not guarantee:

  • Delivery of every email to the recipient's inbox
  • That the Service will be error-free or uninterrupted

To the maximum extent permitted by law:

  • We are not liable for indirect, incidental, special, or consequential damages arising from your use of the Service
  • Our total liability is limited to the amount you paid for the Service in the 12 months preceding the claim
  • We are not responsible for damages resulting from email delivery failures, including lost revenue, missed communications, or business disruption

Termination

By You

You may terminate your account at any time through the dashboard settings or by contacting us. Upon termination:

  • Your API keys will be immediately revoked
  • Your data will be retained for 30 days, after which it will be permanently deleted
  • Any outstanding payment obligations remain due

By Us

We may suspend or terminate your account if:

  • You violate these Terms or the Acceptable Use Policy
  • Your account has been inactive for more than 12 months
  • We are required to do so by law

For non-urgent violations, we will provide 7 days' notice before termination. Severe violations (e.g., sending malware, phishing) may result in immediate termination without notice.

Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of the Service will be resolved through good-faith negotiation first, and if unresolved, through binding arbitration or the courts of competent jurisdiction.

Changes to Terms

We may modify these Terms from time to time. When we make material changes:

  • We will update the "Last updated" date and version number at the top of this page
  • We will notify you via email at least 30 days before the changes take effect
  • Your continued use of the Service after the effective date constitutes acceptance of the modified Terms

If you do not agree to the modified Terms, you must stop using the Service and close your account before the effective date.
